An appeals court panel said President Donald Trump can use $3.6 billion in military funds for the southern border wall.
The Jan. 8 ruling came less than a month after Judge David Briones, a Bill Clinton appointee, issued a permanent nationwide injunction against using the funds.
The Fifth Circuit Court of Appeals granted a stay of the Texas judge’s injunction as the case continues.
Ronald Reagan appointee Judge Edith Jones and Trump appointee Judge Andrew Oldham ruled to block the lower court’s ruling while Judge Stephen Higginson, a Barack Obama appointee, dissented.
