Blanche said it was “common sense” that reposts shouldn’t count. Merchan wasn’t buying it.
Justice Juan Merchan appeared deeply skeptical of Todd Blanche’s argument that Trump’s “reposts” of other people’s commentary shouldn’t count as violations of the gag order.
“Tell me what case law you have to support that,” Merchan instructed Blanche.
“I don’t have any case law to support that. It’s just common sense, Your Honor,” Blanche replied.
When something is reposted, Merchan asked, “How does it get there? How does it get on to your client’s Truth Social account?”
Blanche told him that reposts are done by “a group of folks” who work with Trump.
“It requires some sort of action?” Merchan asked.
“Of course,” Blanche said.
