An effort to boot Madison Cawthorn off the ballot hit the skids on procedural grounds, thanks to redistricting

Those challenging his eligibility are no longer in his district after lines were redrawn.

Challenge rejected: An effort to boot Rep. Madison Cawthorn (R-N.C.) from the ballot — by claiming he helped stoke the Jan. 6 insurrection — hit a snag Thursday when state officials denied the effort on technical grounds.

Several of Cawthorn’s constituents filed the challenge to the congressman’s eligibility, citing the 14th Amendment’s prohibition on insurrectionists from holding federal office. They pointed to his pushing false claims of election fraud and his promotion of the Jan. 6 Ellipse rally as evidence he should no longer be eligible for office. Cawthorn sued to prevent the North Carolina State Board of Elections from considering the challenge, but state officials had fought back, claiming they had the right to consider it.

All that changed after a court-ordered redistricting resulted in all of Cawthorn’s challengers now being located outside of his prospective district.

Cawthorn’s attorney, James Bopp, Jr., anticipates that this is just a temporary delay for the challengers. “This does not change anything,” he wrote. “The challenge was brought by a national group and they can be expected to refile with people in the District that Cawthorn runs in.”

Cawthorn’s case is due for a hearing before a federal judge on Monday, but it’s also unclear if the matter will move forward given the rejection of the challenge.
